A magistrate of the Contentious-Administrative Court number 2 of Madrid has annulled the order of the regional government that prohibits smoking in public spaces without the safety distance, as well as eating on public transport, according to El País.
Un magistrado del Juzgado de lo Contencioso-administrativo número 2 de Madrid ha anulado la orden del Gobierno regional que prohíbe fumar en espacios públicos sin la distancia de seguridad, así como comer en el transporte público, según avanza El País.
The judge understands that regional regulations cannot be applied when referring to an order from the Ministry of Health that has not yet been previously published in the Official State Gazette (BOE).
El juez entiende que la normativa regional no se puede aplicar al hacer referencia a una orden del Ministerio de Sanidad que aún no ha sido publicada previamente en el Boletín Oficial del Estado (BOE).
