Challenge to be taken against planning permission in Rathcairn.

Dúshlán le tabhairt i gcoinne chead pleanála i Ráth Chairn.

Judge Bronagh O’Hanlon today allowed the Rathcairn Co-operative to enter into a judicial review against An Bord Pleanála’s decision to grant planning permission for a hotel and 30 new houses in the town.

Thug an Breitheamh Bronagh OHanlon cead san Ard-Chúirt inniu do Chomharchumann Ráth Chairn dul i mbun athbhreithniú breithiúnach in aghaidh chinneadh an Bhoird Pleanála cead pleanála a thabhairt dóstán agus 30 teach úr ar an mbaile.

Colm Griffin was granted permission by An Bord Pleanála last month to build the houses and hotel in the heart of the Rathcairn Gaeltacht in County Meath.

Thug an Bord Pleanála cead tógála do Cholm Griffin an mhí seo caite, fé choinne na tithe agus an t-óstán a thógáil i gcroílár Ghaeltacht Ráth Chairn i gContae na Mí.

The co-operative says that the language assessment carried out in relation to the area was flawed.

Deir an comharchumann go raibh locht ar an méasúnú teanga a rinneadh i leith an cheantair.

It showed that the Irish language is much weaker in the area than it is, they say.

Léiríodh ann go bhfuil an Ghaeilge i bhfad níos laige sa gceantar ná mar atá, a deir siad.

An Bord Pleanála states that 70% of the houses are to be set aside for Irish speakers.

Deir an Bord Pleanála go bhfuil 70 faoin gcéad de na tithe le cur ar leataobh do chainteoirí Gaeilge.

But the co-operative says that it will be up to the developers to judge the people’s ability to speak Irish.

Ach deir an comharchumann gur faoin gcead, gur faoi na forbóirí a bheas sé breithiúnas a dhéanamh ar chumas labartha Gaeilge na ndaoine.

The co-operative also says that European Union law on provisions on linguistic diversity and minority languages is being infringed.

Chomh maith leis sin, deir an comharchumann go bhfuil dlí an Aontais Eorpaigh maidir le forálacha faoi éagsúlacht teangacha agus teangacha mionlaithe á shárú.

The judicial review will begin on 22 September

Cuirfear tús leis an athbhreithniú breithiúnach ar 22 Meán Fómhair
